An ‘accident’ or ‘near-accident’ means an adverse event occurring while working that does not result in an injury at work, and does not therefore entail an obligation to report it to the employer or for the employer to report it to INAIL (National Institute for Insurance against Accidents at Work).
An injury at work is any sudden event occurring at work that results in an absolute temporary incapacity leading to absence from work exceeding three days (excluding the day of the injury), a partial (to a degree of 6% or more) or total permanent impairment of mental and physical integrity, or death.
A. ACCIDENT WHILE WORKING: WHAT YOU MUST DO
The worker must inform their employer immediately, even if the accident is minor. If they do not report it, they will lose their entitlement to the allowance for the days preceding the day on which the employer was informed of the accident.
The worker must inform the employer of their tax identification number and the identification number and date of issue of the medical certificate sent to INAIL electronically by the doctor who provided first aid (the doctor at the health facility’s A&E department or another qualified doctor, including the family doctor).
These three pieces of information must be sent immediately, as the employer must report the accident to INAIL within two days.
If the worker notifies late, they will lose their right to the allowance for the previous days.
B. INJURY AT WORK: WHAT YOU MUST DO
In the event of an injury at work, the doctor who provided medical care must send an injury certificate to INAIL. The employer must also report the accident to INAIL.
Injury reporting is mandatory for injuries resulting in more a prognosis of recovery exceeding three days (excluding the day of the injury).
The deadline for filing the report is two days for accidents with a prognosis of recovery exceeding three days, excluding the day of the event, and 24 hours for fatal injuries or injuries with a guarded prognosis.
The employer’s obligation to report the injury to the public safety authority is also met by submitting the injury report electronically.
Injuries at work must be reported electronically. To complete and submit a report of an injury at work, go to (www.inail.it) and select the ‘denuncia/comunicazione d’infortunio’ (‘Injury report/submission’) service on the INAIL website.
After logging in using the SPID (Public Digital Identity System), your CNS (National Service Card) or your CIE (Electronic Identity Card), the service allows you to enter all the details needed to send your report to INAIL (details about the employer, the personal and employment details of the injured person, a description of the injury, details of the medical certificate, and any witnesses and motor vehicles involved).
CERTIFICATE OF INJURY AT WORK
With effect from 22 March 2016, employers can consult details of medical certificates for injuries at work received electronically by Inail using the online ‘Ricerca certificati medici’ (‘Medical certificate search’) function available on the Inail website under the reporting services section. Within the application, you can view, print and save a PDF document by entering the identification number of the medical certificate and the date of issue.
A doctor who issues an injury certificate for their patient can submit the certificate electronically via the application on the Inail website.
You must have login credentials for www.inail.it to access the application. If you do not yet have these credentials, you must submit a ‘Richiesta di attribuzione codice medico e di abilitazione ai servizi on line Inail per i medici esterni’ (‘Request for allocation of a doctor’s code and authorisation for Inail online services for external doctors’) to Inail (the competent regional authority) using one of the following methods:
- through the ‘RICHIEDI ABILITAZIONE MEDICO ESTERNO’ (‘EXTERNAL DOCTOR AUTHORISATION REQUEST’) service available on www.inail.it under the section ‘Accedi ai Servizi Online> Registrazione> Medico esterno/Presidio ospedaliero’ (‘Access online services > Registration > External doctor / hospital centre’);
- by submitting paper forms that you can download from www.inail.it in the ‘Acts and documents’ section (‘ATTI ATTI E DOCUMENTI > Moduli e modelli > Altri moduli > Abilitazione ai servizi online > Medico esterno-modulo’ [ACTS AND DOCUMENTS > Forms and templates > Other forms > Authorisation to use online services > External doctor form’]) to an Inail office, accompanied by an identity document;
- by sending the aforementioned completed and signed forms electronically to the Inail office (e.g. ‘Inail Risponde’ function, certified email (Pec)).
After obtaining authorisation, doctors must log in via using SPID, their CIE or their CNS from the ‘ACCEDI AI SERVIZI ON LINE’ (‘ACCESS ONLINE SERVICES’) section of www.inail.it to gain access to the ‘Certificati Medici di infortunio’ (‘Medical certificates of injury’) service. After logging in and selecting the ‘Medico esterno’ (‘External doctor’) option, you can check/complete your references and personal details (‘IL MIO PROFILO’ (‘MY PROFILE’) section).
The provisions of Article 21 of Legislative Decree 151/2015, which introduced the online transmission obligation on the certifying doctor or health facility providing first aid to the worker, entered into force on 22 March 2016.
