Il saggio si sofferma sulle pronunce più rilevanti con cui la Corte di Cassazione ha ridisegnato in forma binaria il danno non patrimoniale, oggi rappresentato dal danno biologico - dinamico relazionale e dal danno da sofferenza soggettiva interiore, nonché sulle modifiche apportate dall’Osservatorio sulla Giustizia civile di Milano alla tabella milanese pubblicata nella nuova versione il 10 marzo 2021, per analizzare poi i possibili riflessi sul calcolo del danno differenziale e sull’individuazione dell’oggetto delle azioni di rivalsa dell’Inail.

The essay focuses on the most relevant judgments with which the Corte di Cassazione redesigned the non-pecunary damage. This damage is today represented by the biological-dynamic relational damage and by the damage from subjective suffering. The essay also concentrates on the changes made by the Observatory on Civil Justice of Milan to the Milanese table published in the new version on March 21st 2021 to then analyze the possible repercussions on the differential damage calculation and on the identification of the rights of recourse of Inail.
