Il saggio ricostruisce le principali questioni emerse nel recente dibattito sulla sussistenza di un obbligo vaccinale anti Covid-19 nei rapporti di lavoro, sottolineando, da un lato, la decisiva importanza della previsione dell’art. 32 Cost., in base alla quale l’obbligatorietà di un trattamento sanitario, quale certamente è la vaccinazione, può essere imposta solo mediante la legge e, da un altro lato, che, in assenza di tale legge, la mancata vaccinazione può comunque produrre conseguenze sul rapporto di lavoro con riferimento alla idoneità alla mansione, come peraltro accade anche nel caso in cui la legge ha imposto un obbligo al personale sanitario.

The essay reconstructs the main issues emerging in the recent debate on the existence of an anti Covid-19 vaccination obligation in employment relationships, underlining, on the one hand, the decisive importance of the provision of art. 32 of the Constitution, according to which the mandatory health treatment, which certainly is vaccination, can only be imposed by law and, on the other hand, that, in the absence of this law, failure to vaccinate can still produce consequences on the employment relationship with reference to suitability for the job, as also happens in the case in which the law has imposed an obligation on healthcare
personnel.
