A dieci anni dall’emanazione del d.lgs. n. 81/2008, l’Autore ricostruisce la genesi e le principali finalità del provvedimento legislativo con cui è stata modificata e razionalizzata la disciplina della tutela e della sicurezza sul lavoro, evidenziando poi sia alcuni punti critici dell’applicazione del decreto sia alcuni aspetti in relazione ai quali sarebbe opportuno un intervento di affinamento della disciplina pur senza stravolgerne l’impianto. In conclusione l’autore prende in esame le possibili ricadute di alcune recenti riforme del diritto del lavoro sull’effettività della tutela prevenzionistica.

After ten years from the entry into force of legislative decree no. 81/2008, the main Italian law on the protection of health and safety at work, the Author goes through the genesis of the law and the main purposes it was meant to achieve, which entailed a new perspective of the concept of health and safety of workers and represented a frame to look at in order to overcome the fragmentation of previous regulations. The author points also out some critical issues that arose from the application of the law and suggests regulatory measures that could further contribute to positively enforce the spirit and the application of the law. In conclusion, the author takes into account possible repercussions that recently introduced reforms on labor law could have on preventive protection and safety of workers.
