L’articolo affronta il tema del lavoro su piattaforma digitale, nel quale un soggetto gestore, tramite propri software e applicativi, crea occasioni di lavoro mettendo in contatto, in tempo reale, un utente operatore, inteso come il soggetto che opera attraverso la piattaforma per erogare un servizio, e un utente fruitore, ovvero il soggetto che attraverso la piattaforma utilizza il servizio. Tale tipologia lavorativa si sta diffondendo rapidamente nel nostro Paese, grazie soprattutto a multinazionali operanti nel settore dei servizi di trasporto, quali, per citare le più note, Foodora, Deliveroo e Uber. Le problematiche sottese al lavoro su piattaforma digitale riguardano essenzialmente la scarsa tutela offerta ai lavoratori, anche a livello antinfortunistico: nel tentativo di far fronte al predetto problema delle tutele mancanti, sono state proposte soluzioni di natura normativa, giurisprudenziale ovvero territoriale. Dopo aver offerto una panoramica delle predette soluzioni l’articolo offre una propria analisi delle questioni poste, indicando, in particolare, un possibile spunto di riflessione per arrivare a garantire copertura antinfortunistica anche al lavoratore su piattaforma digitale.

The article deals with the issue of work on a digital platform, in which a manager, through their software and applications, creates job opportunities by putting in contact, in real time, an operator user, understood as the person working through the platform for provide a service, and a user user, or the person who uses the service through the platform. This type of work is spreading rapidly in our country, thanks above all to multinational companies operating in the transport services sector, such as, to name the best-known, Foodora, Deliveroo and Uber. The problems underlying the work on the digital platform essentially concern the lack of protection offered to workers, even at the accident prevention level: in an attempt to cope with the aforementioned problem of missing protections, solutions of a normative, jurisprudential or territorial nature have been proposed. After offering an overview of the aforementioned solutions, the article offers its own analysis of the questions posed, indicating, in particular, a possible starting point for reflection to arrive at guaranteeing accident prevention coverage for the worker on a digital platform as well.
