Gli Autori mettono in evidenza le criticità, vecchie e nuove, che caratterizzano il sistema finanziario dell’INAIL, prendendo spunto dalle novità introdotte dal decreto legislativo 106/2009 e dalle recenti sentenze relative alla circolare INAIL n. 73/2003. I tre punti fondamentali, riconducibili al tema centrale dell’autonomia dell’Istituto, sono l’individuazione delle competenze in materia sanitaria, il sistema di gestione degli investimenti e l’individuazione dei livelli di premi e delle prestazioni. Gli Autori rilevano anche gli aspetti di contrasto tra le logiche di finanza pubblica e la struttura assicurativa dell’Istituto, richiamando sia i vincoli imposti dall’esterno che alcune decisioni non condivisibili dell’INAIL che hanno introdotto ulteriori criticità. Svolgono poi alcune considerazioni in ordine alle pronunce dei giudici amministrativi ed al relativo impatto sul sistema assicurativo.

The Authors highlight the problems, old and new, that characterize the financial system of INAIL, taking a cue from changes introduced by Legislative Decree 106/2009 and the recent judgement on the circular INAIL N. 73/2003. The three key points, due to the central theme of the autonomy of the Institute, are the identification of institutional competence in matter of health, the system of investment management and identification of the levels of contribution and benefits. The authors also point out the aspects of conflict between the logic of public finance and the financial structure of the insurance Institute, recalling both externally imposed constraints and some decisions of the Institute that cannot be shared, introducing more critical. They also play some considerations with regard to two recent administrative judgements and the effects on the insurance system.
