Partendo da casi affrontati dalla Corte di Cassazione in sentenze recentissime, l’A. ricostruisce il sistema normativo della sicurezza nelle scuole. E sottolinea che la sicurezza delle scuole è un bene da proteggere a tutela del personale, degli allievi e dei lavoratori delle imprese appaltatrici. Rileva che, al di là delle responsabilità penali che la Corte di Cassazione ha messo in luce, è indispensabile che vengano effettivamente e tempestivamente messe a disposizione le risorse necessarie.
Ed è indispensabile che si provveda a individuare il datore di lavoro delle scuole in un soggetto effettivamente dotato di autonomi poteri decisionali e di spesa.

Beginning with cases addressed by the Court of Cassation for very recent rulings, the Author reconstructs the regulatory system for safety in schools. He stresses that schools’ safety is an asset to protect in order to safeguard staff, students and workers of the contracting companies. The Author observes that, beyond the penal responsibilities that the Court of Cassation has made clear, it is indispensable that the necessary resources are effectively and promptly made available.
It is also imperative that steps be taken to identify the employer of the schools as an individual who has effective autonomous decision-making and spending powers.
