L’art. 13 del D.L. 38/2000 prevede che in caso di menomazioni permanenti digrado pari o superiore al 6% ed inferiore al 16% venga erogato un indennizzo incapitale in funzione del grado di inabilità, del sesso e dell’età dell’infortunato otecnopatico al momento della guarigione clinica.In seguito ad una proposta di abbassamento del grado minimo di indennizzo incapitale della menomazione permanente per danno biologico dal 6% al 4%, sonostati stimati gli oneri derivanti.L’analisi della serie storica degli infortuni e malattie professionali definiti, distintiper grado di menomazione permanente (1% - 15%) ed anno evento (1998-2008), ha permesso di stimare il numero e la distribuzione per sesso e classi dietà degli eventi con grado di inabilità 4% e 5% per gli anni 2009-2013.Per la determinazione degli indennizzi in capitale in corrispondenza dei nuovigradi di menomazione si è determinato dapprima l’importo del punto INAILdistinto per grado e sesso, successivamente si è implementata la “Tabella indennizzoDanno Biologico” approvata con D.M. 12 luglio 2000. La stima dell’onere economico conseguente è stata ricavata come prodotto tra icasi previsti e gli importi proposti nella nuova Tabella.Si è, inoltre, calcolata la spesa prevista nel caso in cui le tabelle di indennizzovenissero rivalutate tenendo conto della variazione dell’indice ISTAT (F.O.I.)intervenuta nel periodo luglio 2000 - dicembre 2007.
