L'Autore esamina criticamente le novità introdotte dal D.Lgs. 38/2000 relative al sistema di classificazione dei datori di lavoro e dei lavoratori ed incidenti sull'assetto gestionale dell'INAIL. Il nuovo sistema non sostituisce, ma si sovrappone a quello previsto dal T.U. del 1965, lasciando all'interprete il difficile compito di armonizzare le due normative, con evidenti problemi di coordinamento che l'A. cerca puntualmente di risolvere, soffermando l'attenzione anche sulla posizione dei nuovi assicurati: dirigenti, lavoratori parasubordinati e sportivi professionisti.

The Author examines the new elements introduced by the Legislative Decree 38/2000 related to the system used to classify employers and workers having an impact on INAIL management. This new system does not replace, but overlaps with the system envisaged by the 1965 Single Text, leaving to the interpreter the difficult task of harmonizing both regulations - with evident problems of coordination that the Author tries to solve by focusing his attention also on the position of the new insured workers: executives, employees and sport professionals.
