I rilievi inquietanti sulla crisi finanziaria e del credito alle piccole e medie impresehanno sollecitato l’Autore ad approfondire le tematiche afferenti alla sicurezza deilavoratori occupati nei cantieri edili. Questi ha così precisato il concetto di specificitàdel rischio in detto segmento produttivo, ripercorrendo il cammino delle direttivedell’Unione europea nella particolare materia infortunistica. È seguita l’esegesiraccordata delle posizioni soggettive responsabili dell’osservanza delle normeinderogabili di prevenzione nel cantiere edile e si sono posti altresì in evidenza gliaccordi sindacali sui Comitati paritetici territoriali per il sostegno tecnico alleimprese di costruzione in tema, per l’appunto, di sicurezza nel luogo di lavoro nonchéper una migliore assonanza organizzatoria anche in vista degli accertamentiispettivi da parte delle competenti istituzioni pubbliche. La sintesi, infine, dell’insiemedelle norme sanzionatorie, generali e speciali, previste a carico dei diversisoggetti responsabili della prevenzione si conclude con prudenti considerazioniintorno al dibattito giudiziale sull’ipotesi di omicidio volontario con dolo eventualein corso avanti la Corte di Assise di Torino sulle morti dei lavoratori della SocietàThyssenkrupp.

The alarming remarks on the financial crisis and the credit to SMEs (small andmedium enterprises) solicited the Author to investigate the topics concerning healthand safety of workers in building sites. The Author has therefore specified the conceptof specific risk in the above mentioned industrial branch going over theEuropean Union’s Directives on work injuries. Then the Author has carried out theinterpretation of three aspects, namely the legal status of those responsible forimplementing regulations on health and safety at work in the construction industry,the agreements among social partners on the so-called bilateral local committees tosupport construction enterprises on health and safety at work issues and to achievea better work organisation also prior to inspections by the relevant public authorities.The summary of the regulations containing sanctions for the different people incharge of preventing work injuries ends with some cautious comments on the trialbefore the Corte d’Assise of Turin (equivalent of a Crown Court in England) for thedeath of some workers at the Thyssenkrupp factory on the charge of voluntaryhomicide.
