Con D.P.R n. 461 del 29 ottobre 2001 è stata disposta la riforma dei procedimenti di riconoscimento della dipendenza da causa di servizio di infermità e dell’equo indennizzo. L’articolo analizza le principali modifiche normative introdotte dal D.P.R. n. 461, attraverso un confronto con la previgente disciplina contenuta nel D.P.R. 20 aprile 1994 n. 349. Sono esaminate tutte le novità relative alle varie fasi in cui si articolano i procedimenti di riconoscimento della causa di servizio e dell’equo indennizzo. Un particolare rilievo è attribuito al rinnovato riparto di competenze fra la Commissione medico-ospedaliera ed il Comitato per le Pensioni Privilegiate Ordinarie introdotto dal D.P.R. n. 461.

The procedure for the acknowledgement of the cause of service and the equitable compensations has been reformed by the Decree of the President of the Republic (D.P.R.) October 29, 2001, no. 461. The paper analyses the main news introduced by the Decree no. 461 by way of comparison between the new regime and the previous one governed by D.P.R. April 20, 1994 no. 349. In particular, all the news regarding the various steps of the procedure for the acknowledgement of the cause of service and the equitable compensations are examined. Specific analysis is devoted to the different powers granted to the Medical Hospital Commission and to the newly established Privileged Ordinary Pensions Committee set by the Decree no. 461.
