Ll'articolo affronta la tematica relativa alla delega di funzioni del datore di lavoro in materia di prevenzione e sicurezza nell'impresa, alla luce delle novità introdotte dal d.lgs. n. 626/1994 e successive modificazioni. vengono analizzati gli elementi costituiti della delega attraverso una breve rassegna delle principali teorie ricostruttive dell'istituto definite dalla giurisprudenza della suprema corte di cassazione e della dottrina. l'istituto, di cui vengono individuati i possibili ambiti e limiti di applicazione, viene quindi riletto alla luce degli ultimi interventi legislativi che lo hanno disciplinato, il d.lgs. n. 626/1994 e il d.lgs. n. 242/1996.

This article deals with the main themes related to delegation of the employer's duty in matters of prevention and safety on the working place, in the light of the recent innovations introduced by d.lgs. n. 626/1994 and following amendments. it analyses the constitutive elements of the delegation of duty by means of a short review of the main reconstructive theories of the institute, which are defined by the jurisprudence of the suprema corte di cassazione and by the doctrine. following an identification of its possible context and limits of application, the institute is then interpreted in the light of the latest legislative interventions by which it was regulated, the d.lgs. n. 626/1994 and the d.lgs. n. 242/1996.
