L¿Autore esamina l¿istituto della rettifica per errore alla luce di quanto disposto dall¿art. 9 del D.Lgs. n. 38 del 2000, il quale, nell¿ambito di un¿ampia rivisitazione del regime dell¿assicurazione obbligatoria contro gli infortuni e le malattie professionali, disegna una nuova disciplina, con effetto retroattivo, dell¿istituto già regolato dall¿art. 55, comma 5, della legge 9 marzo 1989, n. 88. In particolare analizza le questioni alla luce delle prime pronunzie giurisprudenziali e delle indicazioni dell¿Istituto assicuratore, soffermandosi sui punti critici, evidenziati anche in dottrina.

The Author examines the institute of rectifies for error in the light of art. 9 of D.Lgs. n. the 38 of the 2000, which, in the within of a wide rivisitation of the regimen of the obligatory assurance against the professional accidents and diseases, it designs one new discipline, with retroactive effect, of the institute already regulated from the art. 55, comma 5, of the law 9 March 1989, n. 88. In particular, the Author analyzes the matter in the light to the new developments of the judges and of indications by the insuring Institute, and on the critical points, also evidenced in doctrine.
