Il D. Lgs.38/2000 ha rivalutato e ridisegnato il ruolo dell'INAIL, nella convinzione che un Istituto di carattere pubblico possa offrire maggiori garanzie al cittadino lavoratore e all'impresa. Il mezzo è stato quello di individuare funzioni e compiti nuovi, per rendere tale ruolo più rispondente al concetto di tutela: di qui l'estensione dell'Assicurazione a figure professionali nuove, l'affermazione di una nozione di rischio, più ampia rispetto al passato, che tutela nel complesso la persona del lavoratore, grazie al riconoscimento della risarcibilità del danno biologico, ed ancora, il superamento della logica puramente risarcitoria, realizzato attraverso la valorizzazione dell'attività di prevenzione, reinserimento e riabilitazione. L'INAIL è chiamato a ricoprire un ruolo attivo nel campo della sicurezza, non solo finanziando progetti per la messa a norma degli impianti delle piccole imprese e di quelle artigiane, ma anche confrontando la propria esperienza ed informazione con gli altri soggetti che agiscono sul territorio, superando il tradizionale rapporto burocratico con l'utenza per dare spazio ad una logica di partecipazione e contributo alla ricerca delle soluzioni. Il processo innovativo, secondo l'A., richiede anche una maggiore autonomia dell'Istituto, decisionale e fnanziaria.

The Legslative Decree 38/2000 has reaffirmed and re-designed the INAIL role in the firm belief that a state body can provide better guarantees to workers and companies. Therefore new functions and tasks have been identified to make this role more in line with the notion of protection: hence the Insurance extension to new professional profiles; the definition and prevailing of a concept of risk - larger than in the past - which protects the individual in his/her entirety, thanks to the fact that it has been recognized that the biological damage can be compensated; the overcoming of a mere compensation logic, thanks to the enhancement of the prevention, reintegration and rehabilitation activities. INAIL is called upon to play an active role in the field of safety, not only by funding projects to readjust the small size and craft companies' plants to make them comply with EU rules, but also by comparing its experience and information with the other bodies operating on the field, thus overcoming the traditional bureaucratic relations existing with users in order to pave the way for a logic of participation and contribution to the search for solutions. According to the Author, this innovative process also calls for greater autonomy by INAIL at financial and decision-making levels.
