La legge 27 dicembre 2006, n. 296 ha istituito, presso il Ministero del Lavoro edella Previdenza Sociale, il Fondo di sostegno per le famiglie delle vittime di graviinfortuni sul lavoro per assicurare un adeguato e tempestivo supporto ai familiarisuperstiti, anche nei casi in cui i deceduti risultino privi della copertura assicurativaobbligatoria contro gli infortuni sul lavoro e le malattie professionali. La dotazione del Fondo è pari a 5 milioni di euro per ciascuno degli anni 2008 e2009 e di 10 milioni di euro a decorrere dal 2010 (L. 244 del 23 dicembre 2007,art. 2, comma 534).Le prestazioni erogate dal Fondo sono destinate ai soli familiari dei lavoratorideceduti a causa di infortuni sul lavoro e consistono in un beneficio una tantum.Attraverso un’opportuna indagine statistica sono stati stimati sia il numero didecessi dovuti ad infortunio per gli anni 2008-2010, sia la struttura dei nucleifamiliari superstiti.La determinazione degli importi da erogare una tantum agli aventi diritto è stataeffettuata considerando la dotazione del Fondo prevista per il triennio 2008-2010e la distribuzione per numero di componenti dei nuclei familiari superstiti.In base alla spesa prevista per i due enti di previdenza (INAIL, IPSEMA) si èproceduto alla ripartizione della disponibilità del Fondo.

The law n. 296 of 27th December 2006 has created, within the Labour and SocialSecurity Ministry, the support Fund for serious work accident victims’ families,in order to provide to the victims’ relatives a proper and rapid financial help, evenin case he/she does not have the mandatory insurance coverage against workaccidents and professional diseases.Such Fund has an endowment of 5 millions euros for each year 2008 and 2009,and of 10 millions euros from 2010 onwards (Law n. 244 of 23 dicember 2007,art. 2, comma 534).The Fund benefit (a one-off sum) is intended to support only the relatives of aperson who died due to an accident at work.By means of a statistical survey, estimates either of the number of work accidentsduring 2008-2010 or the composition of victim’s family has been provided.Calculation of the one-off sums to give to entitled people, has been done by consideringthe expected Fund endowment for years 2008-2010 and the distributionof victims’ families by number of members.On the basis of the expected cost, for each of the two administrations of INAILand IPSEMA, the available sums have been then divided and assigned to them.
