Il saggio riproduce la relazione di base tenuta nella giornata dedicata alla previdenza sociale nel dialogo tra dottrina e giurisprudenza. L’Autore analizza tre aree tematiche principali: l’assicurazione contro gli infortuni sul lavoro, il sistema pensionistico e la previdenza complementare. Quanto al sistema di assicurazione infortunistica si rileva come la giurisprudenza si sia nel tempo distinta nel riconoscimento di una specificità di tale tipo di assicurazione sociale, impegnandosi in un graduale ampliamento dell’ambito della tutela, in ciò sollecitata da un dialogo sempre vivo con il mondo dottrinario. Entrando nel merito del sistema pensionistico l’Autore si sofferma sulla evoluzione della retribuzione imponibile anche alla luce della più recente normativa e infine traccia le attuali tendenze della previdenza integrativa e dei suoi rapporti con la previdenza obbligatoria.

This essay is an account of the basic report written for the Social Security Day within the context of the dialogue between doctrine and jurisprudence. The Author analyses three main thematic areas: the Industrial Accident Insurance; the pension system; and the complementary social security. As regards the Industrial Accident Insurance system, it can be observed that the jurisprudence has on one hand acknowledged that this type of social insurance has a peculiar specificity and on the other hand it has undertaken a gradual widening of the insurance’s protection scope as a consequence of an ever lively dialogue with the doctrinaire world. As regards the pension system, the author analyses the evolution of the taxable income also in the light of the recent provisions, and finally depicts the current trends both of the integrative social security and of its relationship with the compulsory social security.
