La cospicua giurisprudenza in tema di infortunio in itinere pone sistematicamente in rilievo, ai fini della valutazione della sussistenza dell¿occasione di lavoro e del rischio professionale, gli elementi circostanziali del fatto. Non vengono invece tenute in conto le condizioni soggettive dell¿infortunato, che potrebbero comportare l¿esclusione dell¿indennizzabilità in rapporto all¿emergere di un rischio elettivo. In tal senso assume rilievo critico, nei casi di infortunio mortale, la dicotomia tra l¿inchiesta amministrativa disposta dall¿inail e l¿inchiesta penale disposta dalla magistratura: soltanto nell¿ambito di quest¿ultima, possono infatti emergere elementi utili a qualificare un eventuale stato di ubriachezza o stupefazione, che potrebbe risultare significativo nella causazione dell¿infortunio, e come tale portare ad escludere l¿indennizzabilità. Potrebbe pertanto risultare opportuno, in una prospettiva de jure condendo, fissare una procedura che preveda, per gli infortuni in itinere ad esito mortale, l¿interscambio di informazioni tra le inchieste penale ed amministrativa.

The remarkable jurisprudence in theme of accident in itinere, sets systematically in relief, in order to the evaluation of the subsistence of the occasion of job, the circumstantial elements of the fact. In no account come esteemed the subjective conditions of the persone injured, that could involve the exclusion of the indemnity in relationship to the come out of an elective risk. In this sense engages critical relief, in the cases of deadly accident, the dichotomy between the administrative disposed investigation from the inail and the penal disposed investigation from the magistracy: only in the sphere of this one they can in fact emerge useful elements to qualify a possible state of drunkeness or stupefation, that could result meaningful in the causality of the accident, and like such carry to exclude the indemnity. It¿s therefore useful, in a de jure condendo perspective, fix a procedure that foresees, for the accidents in itinere to deadly result, the interchange of information between the penal and administrative investigations.
