Nonostante sia stato ampliato l'ambito delle categorie di lavoratori che beneficiano della tutela in caso di infortunio o malattia professionale, continuano a restarne escluse alcune, seppur marginali, a causa delle indicazioni contenute nel T. U del 1965, agli artt. 1 e 4, di cui si auspica l'eliminazione. Nel frattempo L'A. rivolge un invito alla giurisprudenza affinché superi questa disparità di trattamento, particolarmente grave a fronte delle malattie professionali emergenti, non tabellate, che possono conseguire anche da attività diverse da quelle manuali in senso stretto. L'estensione della tutela a tutti i lavoratori porterebbe anche alla semplificazione dei rapporti, tra INPS ed INAIL, e alla semplificazione dei servizi offerti.

Even though the classes of workers who benefit from protection in case of industrial accidents or diseases have been increased, some others - though marginal - are still excluded because of indications included in the articles 1 and 4 of the 1965 Single Text that we hope will be deleted. In the meantime the Author invites the judges to overcome in their rulings and decisions this difference of treatment - which is particularly serious considering the emerging industrial diseases not included in the tables which can result also from activities other than the manual ones in the strict sense of the term. The extension of the protection to all workers would also lead to the streamlining of relations between INPS and INAIL, and to the streamlining and rationalization of the services provided.
